These Regulations define the rules for making purchases within the Venetiajewels Online Store run by Venetia spółka z ograniczoną odpowiedzialnością (hereinafter: Venetia / Venetiajewels / Venetia sp. z o. o. ), with its registered office at ul. Wichrowa 7, 05-090 Raszyn, registered in the National Court Register under KRS number 0000793101, NIP 5342603230, REGON 383773053.
1 General provisions
1. The scope of activity of the VenetiaJewels online store is retail sale of gold jewelry with diamonds.
2. The Buyer can make purchases in the Store 24 hours a day, 7 days a week via the website www.venetiajewels.pl
3. The products offered in the VenetiaJewels store are brand new, free from physical and legal defects.
4. The Seller certifies the quality of each diamond product with a VENETIA Certificate of Authenticity.
2 Glossary
1. Store – online store operating at: www.venetiajewels.pl
2. Seller - Venetia spółka z ograniczoną odpowiedzialnością (hereinafter: Venetia sp. z o. o.), with its registered office at ul. Wichrowa 7, 05-090 Raszyn, registered in the National Court Register under KRS number 0000793101, NIP 5342603230, REGON 38377303.
3. Customer – a natural person with at least limited legal capacity and over 16 years of age and a legal person.
4. Product – an item for which you can place an order in the Store.
5. Newsletter - commercial information regarding the Store, in particular commercial information, promotions and loyalty programs.
6. Working days - all days of the week from Monday to Friday, excluding public holidays and Saturdays.
7. Cart - a place where the Customer specifies the details of the order.
3 Registration
1. The customer can register for free in the Venetiajewels Online Store.
2. Registration makes it easier for the Customer to place an order for Products available in the Store by providing access to the Account, and also allows the Customer to modify the data contained therein.
3. In order to register in the Store, the Customer should complete the registration form available on the Store's website, providing his/her data, including: name, surname, e-mail address, password.
4. The Customer has the option of consenting to sending the Store's Newsletter to the e-mail address provided during Registration. The Customer is entitled to unsubscribe from the Store's Newsletter at any time.
4 Terms of placing orders
1. The store sells in the territory of the Republic of Poland and the EU.
2. The Buyer may place orders in the Store after reading the Regulations and Privacy Policy available on the website www.venetiajewels.pl
3. Persons authorized to place orders in the Store are:
a) Customers registered in the Store and having an Account,
b) Unregistered customers.
4. The Customer registered in the Store places an order after logging in to the Store, by adding the Product to the Cart, selecting the delivery method and confirming the order with the "Order and pay" button.
5. A customer who is not registered in the Store places an order by adding the Product to the Cart, selecting the delivery method and confirming the order with the "Order and pay" button. The customer is obliged to provide the data necessary to complete the order in accordance with the procedure posted on the Store's website.
6. To avoid any doubts, information about Products available on the Store's websites does not constitute an offer within the meaning of the provisions of the Civil Code. The information in question constitutes an invitation to submit offers.
7. The Seller confirms acceptance of the Customer's order for processing via e-mail. When the Seller confirms acceptance of the Customer's order for execution, a sales contract is concluded.
8. The basket allows the customer to specify details and calculate the value of the order. Placing Products in the Cart by the Customer does not constitute their reservation. If the number of available Products is exhausted before the Customer confirms the order, the Seller reserves that the order will not be accepted for processing.
9. The customer is obliged to provide the full and correct shipping address and telephone number, which should not change until delivery. The ordered Products will be delivered to the address indicated by the Buyer. The Buyer may also choose a different Product delivery address.
10. Each time the seller presents the jewelry model on the website, it presents the specifications of: diamonds (purity and weight) and precious and semi-precious stones (weight), however, the photos of the product may not fully reflect their size. In case of doubts, at the Customer's request, the Seller will always send additional photos to dispel doubts.
11. The Seller does not cancel an order for a Product that has already been shipped.
12. The processing of orders placed on weekdays after 12 p.m. and on Saturdays, Sundays and holidays begins on the next business day.
5 Payment
1. The condition for accepting an Order for execution is prior payment for the ordered Product.
2. The store provides the following payment types:
a) transfer/credit card/Stripe/Klarna/Przelewy24 - payment to the bank account of the Venetiajewels store of the full value of the order calculated in the calculation, before delivery of the ordered goods.
b) e-voucher - to use this form of payment, enter its number in the order basket in the field "I have an eVoucher, a paper voucher or a gift card". In the next step, you must select one of the payment methods listed in section. 2 letter and).
3. If the value of the order exceeds the value of the e-voucher, the Customer may pay the difference in the form of payment specified in section 2 letter and). If the value of the e-voucher exceeds the value of the order, the Store will not refund the difference.
4. The Buyer purchases the Product in the amount applicable at the time of placing the Order.
5. The price of the Product does not include the cost of delivering the Product, which is indicated on the Store's website in the tab https://venetiajewels.pl/pages/zasady-wysylki
6. The Seller has the right to change prices and delivery costs, in particular in the event of changes to the price lists of services provided by entities performing deliveries. This provision does not apply to orders already in progress.
6 Delivery
1. The product is delivered to the address indicated by the Customer in the order.
2. Orders are issued to the Customer or a person indicated by the Customer in the placed order.
3. A personal VAT invoice is issued for each order; in the case of EU companies, an intra-EU VAT invoice may be issued, provided that at the time of verification on the VIES website (https://ec.europa.eu/taxation_customs/vies/?locale= pl) the company is listed in the register as an active EU VAT payer
4. The Product is delivered via a courier company or InPost parcel lockers. Courier shipments are delivered on business days from 9 a.m. to 5 p.m., InPost shipments - 24/7.
5. The order completion (shipping) deadline is indicated next to the Product and is up to 48 hours from the moment of placing the order for products available immediately, and 6-8 weeks for other products.
6. Foreign shipments are carried out by a courier company. For orders below €200 in Austria, Belgium, Czech Republic, Germany, Hungary, Republic of Ireland, Italy, Latvia, Lithuania, Netherlands, Portugal, Slovakia, Slovenia, Spain - delivery cost is €20 gross for Orders exceeding €200 are processed at the Seller's expense.
7. Foreign shipments are carried out by a courier company. For orders below €500 in Denmark, Finland, Sweden, Iceland - the delivery cost is €30 gross. Orders exceeding €500 are shipped at the Seller's expense.
8. If a shipment with an order value below €200 is not collected or the Seller refuses to accept it, the Seller will refund the purchase price less a handling fee for warehousing of the return amounting to 5% of the value of the order. In such a case, the Seller does not refund delivery costs. In the case of orders worth more than €200, the Seller refunds the purchase price less a handling fee for warehousing of the return amounting to 3% of the value of the order.
9. If the order is returned to the Seller for reasons attributable to the Customer, including incorrect delivery address provided by the Customer, failure to collect the shipment or refusal to accept it, the Customer shall bear the entire cost of re-delivery. The Seller is not liable for any losses incurred if the Customer provides incorrect order data.
10. The Customer is obliged to check the condition of the Product or, if this is difficult, the condition of the shipment immediately after its delivery in the presence of a representative of the entity performing the delivery. If any damage that may occur during transport is detected, the Customer should prepare an appropriate damage report and immediately contact the Seller by phone: +48 511 03 05 04 or by e-mail: care@venetiajewels.pl
7 Warranty and Complaints
1. Products purchased in the VENETIAJEWELS Online Store have a one-year warranty from the Seller and the Manufacturer.
2. The Seller is liable for non-compliance of the goods with the contract on the basis of the warranty specified in the Civil Code.
3. The Customer who is a consumer and purchases the Product for purposes not related to business activity is entitled to the rights arising from the provisions of the Act of May 30, 2014 on consumer rights.
4. Complaints about Products may be sent to the e-mail address: care@venetiajewels.pl or submitted by completing the complaint form below in the attachment.
5. The complaint will be considered within 14 days from the date of its submission. The Customer will be notified about the method of considering the complaint regarding the goods by e-mail, telephone or to the correspondence address indicated by the Customer.
6. A customer who is a consumer may use out-of-court methods of dealing with complaints and pursuing claims, including:
a) may refer the case to the permanent consumer arbitration court operating at the trade inspection with a request to resolve the dispute;
b) may request the provincial trade inspection inspector to initiate mediation proceedings to amicably resolve the dispute;
c) may use free assistance in out-of-court methods of resolving disputes and pursuing claims from district (municipal) consumer ombudsmen and social organizations whose statutory tasks include consumer protection;
d) may use the European ODR (Online Dispute Resolution) platform available at http://ec.europa.eu/consumers/odr/.
8 Product Replacement
1. The Buyer may exchange a given Product for a Product of another model within 60 days from the date of receipt of the Product, after confirmation of such possibility by the Store.
2. The costs of shipping the Product in both directions are borne by the Buyer.
3. The condition for the exchange option is the absence of traces of use of the replaced Product, the original packaging and the attachment of undamaged tags. If this condition is not met, the Seller refuses to make an exchange and returns the Product to the Buyer after the Customer has paid the costs of re-shipment.

9 Withdrawal from the Agreement
1. A consumer or an entrepreneur running a sole proprietorship who has concluded a distance contract (hereinafter referred to as the Withdrawing Customer) may withdraw from it within 14 calendar days without giving a reason and without incurring costs, except for the costs specified in Art. 33, 34 section 2 and 35 of the Act on Consumer Rights of May 30, 2014 (Journal of Laws of 2014, item 827, as amended). To meet the deadline, it is enough to send the declaration before its expiry. A declaration of withdrawal from the contract may be submitted:
a) electronically to the following address: care@venetiajewels.pl
b) in writing to the following address: Venetia sp. z o. o., ul. wichrowa 7, Janki, 05 – 090 Raszyn, Poland
c) on the form constituting an Annex to the Regulations.
2. The withdrawing Customer is obliged to return the Product immediately, no later than 14 days from the date on which he withdrew from the Agreement, to the following address: Venetia sp. z o. o., ul. wichrowa 7, Janki, 05 – 090 Raszyn, Poland – Products are returned at the expense and risk of the withdrawing Customer
3. The Withdrawing Customer, who is also a Customer registered in the Store and has an Account, may withdraw from the contract without incurring return costs within 100 calendar days.
4. The withdrawing Customer is responsible for the reduction in the value of the Product resulting from the use of the Product in a way that goes beyond stating the features of the Product, functionality and nature of the Product.
5. After receiving the returned Product, the Seller refunds the payment to the Withdrawing Customer using the same method of payment as used by the Customer.
6. If the Customer chooses a method of delivering the product to the Customer other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse the additional costs incurred.
10 Final provisions
1. The content of the Regulations may be changed after informing the Users about the scope of the expected changes, no later than 14 days before the date of their entry into force.
2. Any disputes arising between the Seller and the Customer will be resolved by a common court having jurisdiction over the registered office of the Store.

4. The name of the Venetiajewels Online Store, the address at which it is available: www.venetiajewels.pl and all materials contained therein are subject to copyright and are subject to legal protection. Using and distributing them without the consent of the Store owner is prohibited.
5. The law applicable to sales contracts is Polish law.
