These Regulations define the rules for making purchases within the Venetiajewels Online Store run by Venetia spółka z ograniczoną odpowiedzialnością (hereinafter: Venetia / Venetiajewels / Venetia sp. z o. o. ), with its registered office at ul. Wichrowa 7, 05-090 Raszyn, registered in the National Court Register under the KRS number 0000793101, NIP 5342603230, REGON 383773053.
1 General provisions
1. The business activity of the VenetiaJewels online store is the retail sale of gold jewellery with diamonds.
2. The Buyer can make purchases in the Store 24 hours a day, 7 days a week via the website www.venetiajewels.pl
3. Products offered in the VenetiaJewels store are brand new, free from physical and legal defects.
4. The Seller certifies the quality of each product with a diamond with the VENETIA Certificate of Authenticity.
2 Glossary
1. Shop – online shop operating at: www.venetiajewels.pl
2. Seller – Venetia spółka z ograniczoną odpowiedzialnością (hereinafter referred to as: Venetia sp. z o. o.), with its registered office at ul. Wichrowa 7, 05-090 Raszyn, registered in the National Court Register under the KRS number 0000793101, NIP 5342603230, REGON 38377303.
3. Customer – a natural person with at least limited legal capacity and over 16 years of age and a legal person.
4. Product – an item for which an order can be placed in the Store.
5. Individual order - an order for a product manufactured according to the consumer's specification to meet their individual needs. The specific features of this product have a personalized and individual character relating to a specific consumer
6. Newsletter – commercial information regarding the Store, including in particular commercial information, promotions and loyalty programs.
7. Working days – all days of the week from Monday to Friday, excluding public holidays and Saturdays.
8. Basket – the place where the Customer specifies the details of the order.
3 Registration
1. The Customer can register free of charge in the Venetiajewels Online Store.
2. Registration makes it easier for the Customer to place an order for Products available in the Store by providing access to the Account, and also enables the Customer to modify the data contained therein.
3. In order to register in the Store, the Customer should complete the registration form located on the Store's website, providing his/her data, including: name, surname, e-mail address, password.
4. The Customer may consent to receive the Store Newsletter to the email address provided during Registration. The Customer may unsubscribe from the Store Newsletter at any time.
4. Conditions of placing orders
1. The Store sells in the territory of the Republic of Poland and the EU.
2. The Buyer may place orders in the Store after reading the Regulations and Privacy Policy, available on the website www.venetiajewels.pl
3. Persons authorized to place orders in the Store are:
a) Customers registered in the Store and having an Account,
b) Unregistered customers.
4. The Customer registered in the Store places an order after logging in to the Store, by adding the Product to the Cart, selecting the delivery method and confirming the order by clicking the button – “Order and pay”.
5. A Customer who is not registered in the Store places an order by adding the Product to the Cart, selecting the delivery method and confirming the order by clicking the button - "I order and pay". The Customer is obliged to provide the data necessary to complete the order in accordance with the procedure posted on the Store's website.
6. For the avoidance of doubt, information about Products available on the Store's websites does not constitute an offer within the meaning of the provisions of the Civil Code. The information in question constitutes an invitation to submit offers.
7. The Seller confirms the acceptance of the Customer's order for execution via e-mail. The moment the Seller confirms the acceptance of the Customer's order for execution, the sales contract is concluded.
8. The Cart allows the Customer to specify details and calculate the value of the order. Placing Products in the Cart by the Customer does not involve their reservation. If the quantity of available Products is exhausted before the Customer confirms the order, the Seller reserves that the order will not be accepted for execution.
9. The Customer is required to provide a full and correct shipping address and telephone number, which should not change until delivery. The ordered Products will be delivered to the address provided by the Buyer. The Buyer may also choose a different delivery address for the Product.
10. The Seller on the website, each time presenting a model of jewelry, presents the specification: diamonds (their purity and mass) and precious and semi-precious stones (mass), however, the posted photos of the product may not fully reflect their size. In case of doubts, at the Customer's request, the Seller will always send additional photos to dispel doubts.
11. The Seller does not cancel an order for a Product that has already been shipped.
12. Fulfillment of orders placed on weekdays after 12:00 and on Saturdays, Sundays and public holidays will begin on the next business day.
5 Payment
1. The condition for accepting an Order for execution is prior payment for the ordered Product.
2. The store accepts the following types of payment:
a) bank transfer/credit card/Stripe/Klarna/Przelewy24 – payment to the Venetiajewels store bank account of the full order value calculated in the calculation, before the delivery of the ordered goods.
b) e-voucher – to use this form of payment, enter its number in the order basket in the field “I have an eVoucher, Paper Voucher or Gift Card”. In the next step, select one of the payment methods listed in paragraph 2 letter a).
3. If the value of the order exceeds the value of the e-voucher, the Customer may pay the difference in the form of payment specified in paragraph 2 letter a). If the value of the e-voucher exceeds the value of the order, the Store will not refund the difference.
4. The Buyer purchases the Product at the price applicable at the time of placing the Order.
5. The price of the Product does not include the cost of delivery of the Product, which is indicated on the Store's website in the tab https://venetiajewels.pl/pages/zasady-wysylki
6. The Seller has the right to change prices and delivery costs, in particular in the event of a change in the price lists of services provided by entities carrying out deliveries. This provision does not apply to orders already being fulfilled.
6 Delivery
1. The product is delivered to the address indicated by the Customer in the order.
2. Orders are issued to the Customer or the person indicated by the Customer in the placed order.
3. A personal VAT invoice is issued for each order, in the case of EU companies, an intra-EU VAT invoice may be issued provided that at the time of verification on the VIES website (https://ec.europa.eu/taxation_customs/vies/?locale=pl) the company is registered as an active EU VAT payer.
4. The Product is delivered by a courier company or InPost parcel lockers. Courier shipments are delivered on working days from 9 a.m. to 5 p.m., InPost shipments are delivered 24/7.
5. The order fulfillment (shipment) deadline is indicated for the Product and is up to 48 hours from the moment of placing the order for products available immediately, and 6-8 weeks for other products.
6. Shipments abroad are carried out by a courier company. For orders below €200 in Austria, Belgium, Czech Republic, Germany, Hungary, Republic of Ireland, Italy, Latvia, Lithuania, Netherlands, Portugal, Slovakia, Slovenia, Spain - the cost of delivery is €20 gross for Orders exceeding the value of €200 are carried out at the Seller's expense.
7. International shipments are carried out by a courier company. In the case of orders below €500 in Denmark, Finland, Sweden, Iceland - the delivery cost is €30 gross for Orders exceeding the value of €500 are carried out at the Seller's expense.
8. In the event of failure to collect a shipment with an order value of less than €200 or refusal to accept it, the Seller shall refund the purchase price reduced by a handling fee for return storage services amounting to 5% of the value of the order. In such a case, the Seller shall not refund the delivery costs. In the case of orders with a value above €200, the Seller shall refund the purchase price reduced by a handling fee for return storage services amounting to 3% of the value of the order.
9. If the order is returned to the Seller for reasons attributable to the Customer, including due to an incorrect delivery address provided by the Customer, failure to collect the shipment or refusal to accept it, the Customer shall bear the full cost of re-delivery. The Seller shall not be liable for any losses incurred in the event that the Customer provides incorrect information for the order.
10. The Customer is obliged to check the condition of the Product or, if this is difficult, the condition of the shipment immediately after its delivery in the presence of a representative of the entity carrying out the delivery. In the event of finding any damage that may have occurred during transport, the Customer should draw up an appropriate damage report and immediately contact the Seller by phone: +48 511 03 05 04 or by e-mail: care@venetiajewels.pl
7 Warranty and Complaints
1. Products purchased in the VENETIAJEWELS online store are covered by a one-year warranty from the Seller and the Manufacturer.
2. The Seller is liable for the non-conformity of the goods with the contract under the warranty specified in the Civil Code.
3. A Customer who is a consumer and purchases the Product for purposes unrelated to business activity is entitled to rights arising from the provisions of the Act of 30 May 2014 on consumer rights.
4. Complaints about the Products may be submitted to the e-mail address: care@venetiajewels.pl or by filling out the complaint form below in the attachment.
5. The complaint will be considered within 14 days of its submission. The Customer will be notified of the method of handling the complaint regarding the goods by e-mail, telephone or to the correspondence address provided by the Customer.
6. A customer who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including:
a) may refer the case to a permanent consumer arbitration court operating at the Trade Inspection Authority with a request to resolve the dispute;
b) may request the provincial inspector of the trade inspection to initiate mediation proceedings to amicably resolve the dispute;
c) may use free assistance in the matter of out-of-court methods of resolving disputes and pursuing claims from district (municipal) consumer ombudsmen and social organisations whose statutory tasks include consumer protection;
d) may use the European ODR (Online Dispute Resolution) platform available at http://ec.europa.eu/consumers/odr/.
8 Product Replacement
1. The Buyer may exchange a given Product for a Product of a different model within 60 days from the date of receipt of the Product, after confirmation of such possibility by the Store.
2. The costs of shipping the Product in both directions are borne by the Buyer.
3. The condition for using the exchange option is the lack of traces of use of the exchanged Product, possession of the factory packaging and attachment of undamaged tags. In the event of failure to meet this condition, the Seller refuses to make the exchange and returns the Product to the Buyer after the Customer has paid the costs of re-shipping.
4. A product made to individual customer order cannot be returned or exchanged.
9. Withdrawal from the Agreement
1. A consumer or an entrepreneur running a sole proprietorship who has concluded a distance contract (hereinafter referred to as the Withdrawing Customer) may withdraw from it within 14 calendar days without giving any reason and without incurring any costs, except for the costs specified in art. 33, 34 sec. 2 and 35 of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). To meet the deadline, it is sufficient to send a declaration before it expires. The declaration of withdrawal from the contract may be submitted:
a) by e-mail to care@venetiajewels.pl
b) in writing to the following address: Venetia sp. z o. o., ul. Wichrowa 7, Janki, 05 – 090 Raszyn, Poland
c) on the form constituting an Annex to the Regulations.
2. The Withdrawing Customer is obliged to return the Product immediately, no later than 14 days from the date on which he withdrew from the Agreement, to the following address: Venetia sp. z o. o., ul. Wichrowa 7, Janki, 05-090 Raszyn, Poland – The return of the Products is at the expense and risk of the Withdrawing Customer.
3. The Withdrawing Customer who is also a Customer registered in the Store and has an Account may withdraw from the contract within 100 calendar days without incurring any return costs.
4. The Withdrawing Customer shall be liable for any reduction in the value of the Product resulting from the use of the Product in a manner that goes beyond the determination of the Product's features, functionality and nature of the Product.
5. After receiving the returned Product, the Seller shall refund the payment to the Withdrawing Customer using the same method of payment that the Customer used.
6. If the Customer selects a method of delivering the product to the Customer other than the cheapest standard method of delivery offered by the Seller, the Seller is not obliged to refund the additional costs incurred by the Customer.
10 Final provisions
1. The content of the Regulations may be changed after informing the Users about the scope of the expected changes, no later than 14 days before their entry into force.
2. Any disputes arising between the Seller and the Customer will be resolved by a common court with jurisdiction over the seat of the Store.

4. The name of the Venetiajewels Online Store, the address where it is available: www.venetiajewels.pl and all materials contained therein are subject to copyright and are subject to legal protection. Their use and distribution without the consent of the Store owner is prohibited.
5. The law applicable to sales contracts is Polish law.
